Diversions

The Osage County Attorney’s Office diversion program is intended to give a “second chance” to offenders who commit a relatively minor criminal or traffic offense. Diversion is a privilege and not a right. There is no guarantee diversion will be granted in any given case. The needs of the offender are less important than those of public safety and the rights of the victim(s). In determining whether to grant diversion, the County Attorney will consider if the defendant demonstrates a genuine sense of remorse and is prepared to acknowledge the act(s) charged and the accountability for the consequences of their actions.

The following downloadable documents outline our diversion policies. Please read them carefully before downloading and filling out a diversion application to make sure you qualify and do what is necessary to be approved for diversion.

Diversion application forms will need to be filled out completely and submitted to the Osage County Attorney's Office.

Adult Application (Includes DUI offenses)
Traffic Diversion Application
Juvenile Application

**** IMPORTANT****   Please do not pay the District Court before the diversion is filed.  This will void your diversion and go down as a guilty charge.  If you choose to pay online, you must make special arrangements with the Osage District Court to pay their portion; our portion can be paid by clicking the red link below.  If you choose to use the mail method, please mail both the County Attorney's payment and the District Court's payment together.

We accept payment by:  money order, bank check, or personal check. Please note that if your personal check bounces your diversion will automatically be rejected. We can also take cash in person, but there must be exact change for both our payment and the District Court's payment.

Diversion ONLINE PAYMENT only - ***Be aware there is a fee associated with using this type of payment**
